Article 2 – Prices The prices of our products are indicated in euros, inclusive of all taxes (VAT and other applicable taxes on the day of the order), unless otherwise stated, and excluding processing and shipping costs. For orders shipped to countries other than mainland France, you are the importer of the product(s) in question. Customs duties, other local taxes, import duties, or state taxes may be payable. These duties and amounts are not the responsibility of SAS PH2B. They are your responsibility, both in terms of declarations and payments to the relevant authorities and organizations in your country. We advise you to inquire about these matters with your local authorities. All orders, regardless of origin, are payable in euros. SAS PH2B reserves the right to modify its prices at any time, but the product will be invoiced based on the price in effect at the time the order is validated and subject to availability. The products remain the property of SAS PH2B until full payment is received. Warning: as soon as you take physical possession of the ordered products, the risks of loss or damage to the products are transferred to you.
Article 3 Orders You can place an order on the website: www.hoofoliucare.com, after creating an account. Contractual information is presented in French and will be confirmed no later than when your order is validated. SAS PH2B reserves the right not to process a payment or confirm an order for any reason whatsoever, particularly in the event of supply problems or difficulties concerning the order received.
Article 4 Order Confirmation: Any order placed through the website www.hoofoliucare.com implies acceptance of these Terms and Conditions. Any order confirmation constitutes your full and unreserved acceptance of these Terms and Conditions of Sale. All data provided and the recorded confirmation will serve as proof of the transaction. You acknowledge having full knowledge thereof. The order confirmation will serve as your signature and acceptance of the transactions carried out. A summary of your order information will be sent to the email address provided during the ordering process, as well as to your personal account created on the website www.hoofoliucare.com. These Terms and Conditions of Sale are available at any time on the website www.hoofoliucare.com.
Article 5 – Payment Confirming your order implies your obligation to pay the indicated price. Payment for your purchases must be made by credit card through the secure Paybox system provided by our financial partner, Crédit Agricole.
Article 6 – Right of Withdrawal In accordance with Article L.121-21 of the French Consumer Code, you have a 14-day withdrawal period from the date of receipt of your products to exercise your right of withdrawal without having to provide any justification or pay any penalty. Returns must be made in their original condition and complete (packaging, accessories, instructions). You are responsible for the condition of the returned items. Any damage to the product during this period may invalidate your right of withdrawal. Return shipping costs are the responsibility of the buyer. If you exercise your right of withdrawal, SAS PH2B will refund the amounts paid within 30 days of receiving your notification, using the same payment method used for the original order. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to: – The supply of goods made to the consumer's specifications or clearly personalized. – The supply of goods liable to deteriorate or expire rapidly. – The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection. – The supply of goods which, after delivery, are, by their nature, inseparably mixed with other items.
Article 7– Availability Our products are offered as long as they are visible on the website www.hoofoliucare.com and while stocks last. If a product becomes unavailable after you place your order, we will inform you by email. Your order will be automatically cancelled and no payment will be taken.
Article 8 – Delivery: Products are delivered to the delivery address indicated during the ordering process, within the timeframe specified on the order confirmation page. In the event of a shipping delay, you will be notified by email of any potential impact on the delivery timeframe initially provided. In accordance with legal provisions, in the event of a delivery delay, you have the option to cancel the order under the terms and conditions defined in Article L 138-2 of the French Consumer Code. If you receive the product in the meantime, we will proceed with a full refund, including shipping costs, in accordance with Article L 138-3 of the French Consumer Code. For deliveries made by a carrier, SAS PH2B cannot be held responsible for delivery delays due solely to your unavailability after several delivery attempts. Delivery costs are calculated based on the weight and destination of the order. They are provided to you during the ordering process. Delivery is free for orders over 100 euros excluding VAT.
Article 9 – Warranty All our products are covered by the legal guarantee of conformity and the guarantee against hidden defects, as provided for in Articles 1641 et seq. of the French Civil Code. In the event of a product's non-conformity, it may be returned, exchanged, or refunded. All claims, requests for exchange, or refunds must be made by email to contact@hoofoliucare.com within 7 days of the delivery date. Products must be returned to us in the condition in which you received them, with all components (accessories, packaging, instructions, etc.). Shipping costs will be refunded based on the invoiced rate, and return shipping costs will be refunded upon presentation of proof of payment. The provisions of this Article do not prevent you from exercising your right of withdrawal as provided for in Article 6.
Article 10 – Liability The products offered comply with current French legislation. SAS PH2B cannot be held liable for non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities regarding the import or use of the products or services you intend to order. Furthermore, SAS PH2B cannot be held liable for damages resulting from misuse of the purchased product. Finally, SAS PH2B cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruptions, external intrusions, or the presence of computer viruses.
Article 11 – Applicable Law in Case of Disputes The language of this contract is French. These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction.
Article 12 – Intellectual Property All elements of the website www.hoofoliucare.com are and remain the exclusive intellectual property of SAS PH2B. No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, any elements of the website, whether software, visual, or audio. Any simple or hypertext link is strictly prohibited without the express written consent of SAS PH2B.
